Tort Lawsuits

Tort lawsuits are some of the most common types of lawsuits filed across the United States. In general there are three different types of tort lawsuits in US courts and those include strict liability, intentional tort and negligence. Strict liability tort lawsuits include those that cause serious harm, environmental hazards, and some types of trademark, infringement or product liability cases. They are called strict liability because the individual is going to have some level of liability even if there was not intentional culpability or negligence because the action itself is so extreme and a reasonable individual would have understood harm could occur. Intentional tort is just what the term implies, the offender willfully commits an intentional act knowing that it is going to cause harm to the other person. Defamation of character, battery, assault or trespass are examples. The final type of tort lawsuits are negligence suits. These can include medical malpractice, breach of duty, and damages. Negligence may also result in punitive damages, which are funds awarded to the victim to punish the guilty party.
